Yes. The 0.4mg THC limit would make virtually all hemp products illegal — including non-intoxicating CBD oils, topicals, wellness products, and products with no psychoactive effects.
The provision was championed by Sen. Mitch McConnell, who ironically led hemp legalization in 2018. Various interests, including alcohol industry lobbyists, have pushed for restrictions on hemp products that compete with their markets.
Yes. Hemp products with less than 0.3% Delta-9 THC by dry weight are legal under the 2018 Farm Bill. This new provision will override that, setting limits so low that even non-psychoactive products would be banned.
